How to file divorce petition ?
As per section 14 of Hindu Marriage Act, 1955 "No petition for divorce to be presented within one year of marriage " After expiry of one year either the husband or the wife can file petition under section 13 of HMA for divorce on ground that other party-
(i) has, after the solemnisation of marriage, had voluntary sexual intercourse with any person other than his or her spouse; or
(ia) has, after the solemnisation of marraige, treated the petitioner with cruelty; or
(ib) has deserted the petitioner for a continuous period of not less than two years immediately preceding the presentation of the petition; or
(ii) has ceased to be Hindu by conversion to another religion; or
(iii) has been suffering from mental disorder
(iv) has been suffering from virulent and incurable form of leprosy; or
(v) has been suffering from venereal disease in a communicable form; or
(vi) has renounced the world by entering any religious order; or
(vii) has not been heard of as being alive for a period of seven years
Apart from this both party can file divorce petition on the basis of mutual consent
